Important Update: Changes to Our Service Agreement

At Interchange Shoalhaven, we are committed to providing high-quality support services while maintaining transparency and alignment with the National Disability Insurance Scheme (NDIS). We have recently updated our Terms and Conditions to ensure they reflect current practices, regulatory changes, and your feedback.

These updates will apply to all new service agreements and can also be extended to existing agreements for participants and their representatives.

Key Updates to Note:

  • Summary of Key Changes

    1. Revised Notice Period for Ending Agreements
      • Updated to the written notice requirements and includes further details about charges during the notice period.
    2. Amending Agreements with Written Confirmation
      • Introducing the ability to make minor amendments through mutual written agreement without drafting a new service agreement.
    3. Annual Pricing Updates
      • Pricing adjustments can now align with the latest NDIS Pricing Arrangements without requiring a new agreement.

    These updates are designed to make agreements more flexible and adaptive, ensuring participants receive timely and effective support.

 

Full Updated Terms and Conditions

Revised Clause: “Ending this Service Agreement”
“Should either party wish to end this Service Agreement, they must give 30 days’ notice in writing. During this 30-day notice period, we will continue to roster and provide services as per the agreed schedule. The participant has the option to utilise these rostered services or decline them. However, please note that charges for the rostered services will still apply, regardless of whether the participant chooses to use them or not.

If either party seriously breaches this Service Agreement, the requirement of notice will be waived, and the agreement may be terminated immediately without the 30-day notice period. In such cases, charges for services already provided up to the date of termination will still apply as will the short notice cancellation policy, which requires 7 clear days’ notice as per the NDIS Pricing Arrangements, during the notice period.”


New Clause: “Amending Service Agreements with Written Confirmation”
“In the event changes need to be made to Service Agreements at any time, a written agreement and consent from both parties outlining the requested changes may be utilised in place of provision of an updated Service Agreement reflecting those changes.”


New Clause: “Updating Price of Service Provision”
“Interchange Shoalhaven Limited reserves the right to update the cost of service provision without development of a new Service Agreement to be in line with current service charge rates outlined in the NDIS Price Guide in the event this charge rate updates within the Service Agreement start/end dates.”

What Happens Next?

  • These updated terms will take effect on 1 February 2025 for all participants continuing to use our services.
  • By continuing to use our services after this date, you acknowledge and accept the updated terms and conditions.
